Hi all,

I am translating a Mexican website's Privacy Policy and am unsure whether "indebida" is qualifying all the nouns it follows or if it is just qualifying "divulgación". I believe it is qualifying all of the nouns, but I wanted to check.

The full sentence is:
"Los datos personales que voluntariamente proporcione a XXXXXX serán utilizados para identificarlo, localizarlo y contactarlo; registro en base de datos de contactos; así como cualquier otra finalidad análoga a las aquí establecidas, y estarán protegidos por medidas de seguridad administrativas, técnicas y físicas, para evitar su daño, pérdida, alteración, destrucción, uso, acceso o divulgación indebida.

I am translating a Mexican website for an English as a Lingua Franca speaking audience worldwide. I am not translating for a specific legal system and the document will not have legal standing in the target text.

My take is this: You wouldn't need to protect against normal usage - One would only protect against improper/undue usage. The same goes with alterations/changes, access and disclosure.

I would probably include all nouns, but you could leave out the two in front, damage and loss.

I see that the word unauthorized is commonly when the source is English. Also, it says "accidental or unlawful destruction".

To conclude: I would definitely apply it for all nouns.

agree  philgoddard: This is pretty academic because the overall meaning of the sentence is clear, but indebida is feminine singular, so it refers to divulgación.

Explanation:
I think "indebida" refers only to "divulgación".
That said, you could "cheat", and rephrase it as I suggested.
Another problem is that these nouns require different prepositions in English. I acknowledge this makes it very wordy, but necessary if you make sure the nouns refer to "datos personales" (to translate "su" in Spanish) and keep it grammatically correct.
Otherwise, just keep the nouns (without "thereof" or "thereto"...) and it could still work, as it would be implied by the context.
