Drugostupanjski suci također koriste između 30 i 50% radnog vremena na izradu odluka, a redovito ih izrađuju izvan radnog vremena. Smatraju da se nedostaci prvostupanjskih odluka mogu naći i u njihovu uvodu (npr., navode se umrle osobe i obrtničke radnje kao stranke u postupku, stranke se nepravilno označavaju), izreci (katkad nedostaje odluka o svim zahtjevima ili o prigovoru postojanja tražbina radi prijeboja, izreka nije uvijek dovoljno jasna) i dakako obrazloženju (ocjena dokaza, primjena materijalnog prava, nepotrebna preopširnost, nedostatak obrazloženja odluke o troškovima). Smatraju da je potrebno učiniti dodatni napor na poboljšanju tehnike izrade prvostupanjskih odluka (podjednako «neznatno i «u velikom mjeri») i to tako da se one skrate, budu jasnije i s potpunijim obrazloženjem glede zahtjeva stranaka, činjenica, dokaza i primjene materijalnog prava.
