"dan kakvoće" according to the definition given is the day that is relevant for estimating the value of the property - it is not necessarily the day when the survey/valuation is carried out;

IOW the value of the property is estimated as it would have been at a given reference date / relevant date (that can be days, months or even years before the date when the valuation is being done!)

O PROCJENI VRIJEDNOSTI NEKRETNINA

1. OPĆE ODREDBE

Predmet Zakona

Članak 1.

Ovim Zakonom uređuje se procjena vrijednosti nekretnina, određuju se procjenitelji, sastav i nadležnosti procjeniteljskih povjerenstava i visokog procjeniteljskog povjerenstva, nadležnosti upravnih tijela županija, Grada Zagreba i velikoga grada u provedbi ovoga Zakona, metode procjenjivanja vrijednosti nekretnina, način procjene vrijednosti prava i tereta koji utječu na vrijednost nekretnine, način procjene iznosa naknade za izvlaštene nekretnine, način prikupljanja, evidentiranja, evaluacije i izdavanja podataka potrebnih za procjene vrijednosti nekretnina za sve nekretnine u Republici Hrvatskoj, neovisno o tome u čijem su vlasništvu.

Članak 2.

Ovaj Zakon sadržava odredbe koje su u skladu s Direktivom 2014/17/EU Europskog parlamenta i Vijeća o ugovorima o potrošačkim kreditima koji se odnose na stambene nekretnine i o izmjeni direktiva 2008/48/EZ i 2013/36/EU i Uredbe (EU) broj 1093/2010 (tekst važan za EGP) (SL L 60, 28. 2. 2014.).

Pojmovi

Članak 4.

(1) Pojedini pojmovi u smislu ovoga Zakona imaju sljedeće značenje:

1. cjenovni blokovi grupe su katastarskih čestica koje prema lokalnim uvjetima na tržištu nekretnina postižu sličnu cijenu

2. čisti prihod je razlika između ukupnoga godišnjeg prihoda i troškova gospodarenja

3. daljnja obilježja nekretnine obuhvaćaju stvarno korištenje, prihode, površinu katastarske čestice, oblik katastarske čestice i svojstva tla (bonitet, pogodnosti za gradnju, onečišćenje i sl.), a na izgrađenoj građevnoj čestici to su stanje građevine, njezina namjena, godina građenja, način gradnje, oblikovanje, veličina, opremljenost, energetska svojstva i energetski razred te prinos od njezina korištenja

4. dan kakvoće predstavlja datum na koji se odnosi stanje (kakvoća) nekretnine koje je mjerodavno za procjenu vrijednosti nekretnine

5. dan vrednovanja predstavlja datum na koji se odnosi procjena vrijednosti nekretnine
