Czech term or phrase:correct tense
Jak prosím překládáte např. zápis z jednání. Když je v češtině použit přítomný čas, necháváte přítomný i v angličtině nebo celý text převádíte do minulého času? Říkala jsem si, že v minulém čase to bude v angličtině lepší, ale už jsem z toho trochu zmatená, co převádět do minulosti a co ponechat v přítomném čase :-) Děkuji!

Explanation: Chápu to tak, že minulý čas má tady v kontextu vztah k danému jednání - tedy minulý čas i v angličtině. To, co uvádíte v přítomném čase, jsou nějaké obecné informace o stavu legislativy, tedy určitě přítomný i v angličtině.
It is interesting looking through this thread - I didn't even know what the pluperfect tense was until I was about 20, when we had to do a year of ENGLISH grammar at university before embarking on Russian and other such exotic languages ... We aren't taught all this stuff at school - it all comes sort of naturally without even realising what tenses are involved ... You can tie yourselves in all sorts of knots - best to keep it simple. Your example from court - 'The Defendant objected to the fact that the witness had stated that if at the time of the contract negotiations he had known the given facts he would never have entered into the contract.' Easy :)
Cambridge Grammar of English je VYNIKAJUCA, spominam si ako som tam s uzasom zistil, ze tie styri podmienky, co do nas natlkli v skole, su len malicka podskupina mozneho vyjadrenia podmienky v anglictine. Ale pre bezne prakticke pouzitie mam radsej Modern English Usage od Oxford Press.
Presne. Rigorozna vyuka podporena samostudiom:-))) Mal som etapu, ked som nad tou absenciou jednoznacnosti az salel. Inac osobne mam predminuly cas, minule pricastia trpne a cinne , frazy typu "had had" "Should xxx be" strasne rad a s chutou ich pouzivam, ale skutocne sa hodia len do velmi formalizovanych textov (napriklad pre tie rozsudky, pravne analyzy a pod.) Pri beznom preklade clovek riskuje, ze mu no-native klient nebude rozumiet. Pri zlozitych pravnych textoch to nevadi, tym sa neda poriadne rozumiet ani v originali (co je imho aj umysel autorov):-))
Vtedy sme to riesili cez minule a predminule casy a podmienky (vraj to tak v rozsudkoch ma byt), ale riesenie, ktore vymyslela Lenka je pre zapisnicu celkom sikovne. Podobne v zmluvach do anglictiny by sa mal pouzivat pritomny cas (The Parties agree), ale niekde sa nevyhnete buducemu (V pripade zlyhania bude Dodavatel opravneny), inde predpritomnemu (Zmluvne strany prehlasuju, ze si zmluvu dokladne precitali) a este sa vam do toho pletie shall ako vyjadrenie povinnosti. Nie vzdy existuje gramaticky ciste riesenie, a nie vzdy je nutne.
To jsou myslím pozůstatky naší rigorózní výuky angličtiny. Pokud se však podíváte do moderních anglických gramatik, doporučuji např. Cambridge Grammar of English, pak v případě, který uvádíte, je naprosto běžné použít přítomný čas, protože se jedná o informaci s všeobecnou platností. Proto tedy žádný posun časů. V druhém případě, který uvádíte, se časy samozřejmě neřeší a používá se většinou pouze minulý čas s vyjádřením časové souvislosti pomocí spojek a časových údajů. Obecně se uvádí, že angličtina od předminulých časů v běžných časových větách v podstatě upouští - pak zůstává tedy ve větách podmínkových, přacích atd., kde má tento čas jinou funkci než vyjádření časové okolnosti.
No, jednoznacne riesenie neexistuje. Spominam si, ako sme s kolegom riesili rozhodnutie odvolacieho sudu o jednej zmluve s takymi vetami ako: Obhajca namietal (pri odvolacom konani), ze svedok uviedol (pri prvostupnovom konani), ze keby v case rokovania o zmluve (este pred prvostupnovym konanim)poznal uvedene skutocnosti, zmluvu by nikdy neuzavrel(este pred prvostupnovym konanim, ale uz po rokovani o zmluve). To uz sa nam zacali minat casy:-))
Very cute solution. But (ther is always some BUT) what to do with sentences like "Zduraznila, že v České Republice nejsou stanoveny žádne pomínky..."? Sentence She highlighted that thare are no conditions is gramatically incorrect, you should use future in the past. How to cope with such combined sentences?
But if someone reads the minutes two years later, then the requirement may not apply, though currently it is ongoing :-) "there is no requirement" - refers to other states "is a very strict one" - refers to Czech Republic :-)
as you put it is right. I will try to explain - in the first instance 'there was no reason to adopt' is because it is describing a process that has happened in the past (the adoption of a requirement), however the others describe conditions that are ongoing in the present - 'there is no requirement', 'the requirement is a very strict one'. Dává to vůbec smysl? :)
