I was in doubt whether to use "administration" of division" for the Danish "skifte", but opted for "division". Thanks for your help:)

without dividing the estate with joint heirs

Explanation:
In Scandinavian countries the surviving spouse can elect what is called an "uskiftet bo" or "undivided estate" in English which means that the surviving spouse can keep the estate undivided for the remainder of his or her lifetime. Note that this only applies to jointly held property ("fælleseje") and not property that the deceased spouse owned separately ("særeje"). The link discusses in very general terms some of the rules that govern this area of law.

I would add the word "estate" to lone's translation to fit the "undivided estate" term into the translation.

Typed a bit too fast. It should be "right to elect to"

Example sentence(s):
  • the surviving spouse has the right elect to assume ownership of jointly held property without dividing the estate with joint heirs

Asker: Thanks for your comments. I agree that an addition of "estate" serves well in this connection.
