general provision Explanation: All Google hits for "samlebestemmelse" are Norwegian, not Danish, and maybe that is why it appears in qoutation marks here in your text. I think the Danish term would be "almindelig bestemmelse/regel" (til forskel fra "særregel"). Juridisk ordbog (Helle Pals Frandsen: dansk rets almindelige regler = the general rules of Danish law IATE: general provision = almindelig bestemmelse Your text describes a conflict between the Danish rules and the rules of the EUs regarding VAT. "provision" is used below to describe article 132: "The EU VAT Directive, and the 6th Directive which preceded it, provides an exemption from VAT for certain cost sharing arrangements. Initially it was proposed that this exemption would be applicable only to services supplied by independent professional groups of a medical or like nature to their members for the purposes of their exempted activities. Reflecting this, the relevant legislative provision (now article 132(1)(f) of the VAT Directive) still lies under the heading “Exemptions for certain activities in the public interest”. However, as the provision itself contains no such limitation, some Member States apply the exemption much more widely. " http://www.kpmg.fi/Binary.aspx?Section=174&Item=4766 |
