Thank you textpertise, that helps a lot. @Writeaway: I see that you have been posting admonishments on many of my entries. Please realize I only post a question when I have exhausted all means to translate. You never add anythiing helpful. In this case I was working on a 44 page Flemish legal brief which involved a tremendous amount of work on my part. Kindly cease and desist!

If said ruling is not favorable for the party concerned (claimant in this case) then he can go to casssation and attempt to have it rule that the judgement does not apply and that the court case must be reconsidered.
That is, of course, if we are not talking about what Textpertise is addressing here, although it would be a very odd way in Dutch to phrase that.

for example the Juridisch Woordenboek Belgisch recht defines
verbrekingsvergoeding as:
(contractenrecht) "een vergoeding die een contractspartij aan de andere partij zal moeten betalen bij vroegtijdige beëindiging van de overeenkomst. In vele contracten is een beding opgenomen waarbij een verbrekingsvergoeding wordt voorzien." Of course, we are speaking here of verbreking and not verbrekingsvergoeding. My thoughts therefore go out to the idea that a right to premature termination of the contract is being reserved here, but that doesn't make any sense unless the contract still subsists. Does it? I can't see any meaning other than that the insurer is reserving the right to terminate the contract prematurely in protest at the judgement. I look forward with interest to any other insights our colleague translators may come up with.

Sure, the appellee is a third party insurer that is appealing an earlier decision in order to get compensation for the moneys it has had to pay out. This particular sentence indicates what it would do if the court does not agree with one of its assertions. I hope that helps! Thank you!
