Dear colleagues,
I have a bit of a struggle to find appropriate translations for behoeftigheid and behoefte in the following sentence of a divorce agreement:
De partneralimentatie kan bij gewijzigde omstandigheden indien zich niet-financiële factoren voordoen (wangedrag naar aanleiding van objectieve maatstaven) waardoor in redelijkheid niet langer van de alimentatiebetaler kan worden verlangd dat hij/zij (dit bedrag aan) partneralimentatie betaalt, of zich een wijziging voordoet in de behoeftigheid, de behoefte (verdiencapaciteit), de draagkracht of de vrije ruimten van partijen in onderling overleg of bij rechterlijke uitspraak worden gewijzigd.
My Juridisch-Economisch Lexicon has "need" for both terms. I would be very grateful for any suggestions or ideas. Thanks!
Explanation: Please see my reference note below. I realised later that the site concerned is an offical EU site and provides a translation of the above in Dutch. This reads:
"Indien de verweerder aantoont dat de staat van behoefte van de verzoeker te wijten is aan zijn eigen beslissing die niet was ingegeven door de noden van de familie, kan de rechtbank hem ontheffen van het betalen van een onderhoudsuitkering of het bedrag ervan verminderen (artikel 301, §§ 1-2 en 5 BW). Het bedrag van de uitkering moet ten minste de staat van behoefte van de uitkeringsgerechtigde dekken en mag niet hoger liggen dan een derde van het inkomen van de uitkeringsplichtige."
I think 'staat van behoefte' comes pretty close to 'behoeftigheid', although one could argue that this is a more or less qualitative refinement of 'behoeftigheid, compared, for example, with 'mate van behoefte'. In the context of the question asked, however, I would say that 'behoeftigheid' is being used in a qualitative rather than a quantitative sense and that it would be quite in order to interpret the term as meaning the same as 'staat van behoefte'.
Thanks, you're absolutely right about after 'behoeftigheid' >> after 'behoefte', but should be 'behoeftigheid'. I've just rephrased my last comment a little to make things less confusing.
I agree that the source text is confusing and that rephrasing the most relevant part as de behoefte, de behoeftigheid (verdiencapaciteit), de draagkracht would indeed make more sense.
The reason why 'verdiencapaciteit' is mentioned in brackets after what should have read 'behoeftigheid' rather than 'behoefte' is IMO quite simply because both concepts are closely related (i.e. 'behoeftigheid' is determined 'aan de hand van' earning capacity - see your ref and see also the ref in my previous entry - but the two are not synonyms).
So we agree that 'earning capacity' relates to 'alimentatiegerechtigde'.
Apparently I did not understand you correctly at this point. As far as 'behoeftigheid' is concerned, I rely on the refs:

In my last entry, I used the term 'earning capacity' to refer to the 'verdiencapaciteit' of the 'requesting spouse' (= alimentatiegerechtigde) so I'm not quite sure what your comment is related to...
The term 'draagkracht' (ability to pay) would apply to the 'alimentatieplichtige' (supporting spouse).
As for treating 'behoeftigheid' en 'verdiencapaciteit' as synonyms, I don't think that's correct. Have a look at the following example of how these three concepts (behoefte, behoeftigheid, verdiencapaciteit) are understood and used in court practice:
De vrouw stelt dat haar behoefte in de beschikking van de rechtbank Den Haag van 12 september 2006 is vastgesteld op € 6.453,- per maand. PS. I find the reference to 'behoefte (verdiencapaciteit)' in your source text rather confusing. From what I can see, 'verdiencapaciteit' is more closely related to the concept of 'behoeftigheid'.

Not sure really, although I might be inclined to translate one of them as "needs", rather than "need".

"If the wife has not a sufficient income for her maintenance pending the suit for separation from bed and board or for divorce, the judge shall allow her, whether she appears as plaintiff or defendant, a sum for her support, proportioned to her needs and to the means of her husband.
