Ik heb een document van de rechtbank dat ik moet vertalen, en daarin wordt de term 'ongewenstverklaring' gebruikt. Het klinkt alsof dit betekend dat de persoon in questie niet welkom is in Nederland, maar het is niet hetzelfde als deporteren. De persoon wordt geacht vrijwillig het land te verlaten.

" Bij besluit op 'datum' is eiseres ongewenst verklaard. Bij belsuit op 'datum' is het bezwaar tegen het besluit tot ongewenstverklaring ongegrond verklaard."

Explanation:
The Juridisch-Economisch Lexicon translates 'ongewenstverklaring' as 'order declaring a person an undesirable foreign national'. However, I prefer the IATE translation: 'order declaring a person an undesirable alien'. IATE also gives 'pronouncement of undesirability', which is similar to Frank's answer. So basically, there seem to be two semi-standard English translations of 'ongewenstverklaring':

– 'order declaring a person an undesirable alien' (IATE) or 'order declaring a person an undesirable foreign national' (JurLex)
– 'pronouncement of undesirability' (IATE) or 'declaration of undesirability' (Frank's answer)

The latter a shorter version, and the former a more extended form. I have come across more examples of 'pronouncement of undesirability' used online than 'declaration of undesirability'. Hence my answer.

• 'order declaring a person an undesirable alien' --> 'Furthermore, the request to lift the *order declaring a person an undesirable alien* may be made after a reasonable period of time has elapsed since expulsion for reasons of public policy or public security or if the expulsion was made at least three years prior to the request. As Frank commented in Barend's answer, an 'exclusion order' is a logical consequence of a 'ongewenstverklaring'. See, e.g.:

'On 22 October 1997, on the basis of the conviction, the State Secretary of Justice (Staatssecretaris van Justitie) declared the applicant an undesirable alien (ongewenstverklaring), entailing an exclusion order valid for 10 years.' Incidentally, JurLex translates 'exclusion order' as 'gebiedsontzegging', and Macmillan defines 'exclusion order' as 'an official order by a court that tells someone not to go to a particular place'.

••• NOTE: I think I actually prefer (Frank's) 'declaration of undesirability' to (IATE's) 'pronouncement of undesirability', which does sound a little Dunglish. My favourite long version, however, is still 'order declaring a person an undesirable alien'.

I would therefore like to change my answer to:

1. order declaring a person an undesirable alien
2. declaration of undesirability
