Volgens HR 22 december 1978, NJ 1979, nr. 521, Tv A 1980, p. 25 inzake Zaunbrechter ca. Muyzert. m.nt. P.S(anders) dient de rechter 'in een zodanig geval wél te beoordelen welke van deze maatstaven de scheidslieden hadden behoren aan te leggen en of zij blijkens hun beslissing inderdaad die maatstaf hebben aangelegd, maar niet op welke wijze en met welk resultaat zij di! hebben gedaan'. Dat laatste had het Hof aldus de HR die het arrest van het Hof vernietigde uit het oog verloren door te onderzoeken of de arbitrators, die als g.m.nt.b oordeelden, daarbij tevens de regelen des rechts hadden gevolgd. De verleiding tot zulk een onderzoek is groot, maar leidt tot een inhoudelijke toetsing van het arbitrale vonnis.

Eveneens komt het nog al eens voor, dat arbitrators der gewoonte getrouw verklaren als g.m.nt.b te oordelen hoewel zij de opdracht daartoe niet hadden.

It is odd that the scan clearly shows nt. but in the face of this overwhelming evidence I have to agree. Maybe the typesetter couldn't type very well.

I wouldn't know then. Either you accept the abbreviation for what it is, or ask your client to find in the book where the abbreviation was first used, or translate as you think and make a translators note.

I'm not talking about typos, but about OCR mistakes. OCR takes the image of a scan and interprets it to create an editable document. Sometimes that goes wrong - as with the "t" being recognised as "!".

It's worth checking where the text comes from.

no, the term g.m.nt.b. appears 3 times in the same form on the same page, so it could hardly be a typo. I don't think Sanders was that careless.

I'm hardly a genius, but could it be that your problems are caused by a bad scan + OCR? Maybe it helps if you could get to see the scan as an image. Usually they sent that one along for reference.

For example, "m.nt. P.S(anders)" actually should be m.nt. P. Sanders - meaning "with a note written by P. Sanders". There is also the non-existing word "di!".

Alternatively, you might get lucky and find a good scan on Google books.

It appears this could stand for "goede mannen naar billijkheid" - but the problem is the "nt."
Maybe some genius out there can suggest something.
