bare owner Explanation: This refers to persons enjoying so-called bare ownership (NL blote eigendom, nuda proprietas) in situations involving some type of usufruct (NL vruchtgebruik, (usufructus). My 2011 download version of JurLex contains both bare owner and naked owner but these entries seem to have been updated/changed since and replaced by 'holder of a principal right' (see D-box entries posted by Michael). I'll leave it to someone else to either confirm or reject this option. Reference: hoofdgerechtigde (in de context van vruchtgebruik) Reference information: VRUCHTGEBRUIK Bij testament kan een vruchtgebruik voor de langstlevende echtgenoot worden vastgelegd. Deze constructie houdt in dat de vruchtgebruiker het recht heeft op het gebruik van bepaalde goederen, maar dat de eigendom van die goederen toebehoort aan iemand anders, namelijk de hoofdgerechtigde. De vruchtgebruiker van een huis mag hier gratis in wonen en de vruchtgebruiker van een bankrekening krijgt de rente. De vruchtgebruiker is echter wel verplicht de goederen waarvan hij de vruchten geniet in stand te laten. Zo zal hij het huis moeten onderhouden en mag hij niet aan de hoofdsom van de bankrekening komen, tenzij de erflater dit nadrukkelijk anders heeft bepaald. Vruchtgebruik Aan iemand kan het recht worden toegekend om het genot van bepaalde goederen te hebben. Zo iemand wordt "vruchtgebruiker" genoemd. Het vruchtgebruik van een woning wil zeggen dat de vruchtgebruiker gratis in het huis mag wonen. Als iemand het vruchtgebruik van een bankrekening heeft, dan mag hij de rente in zijn eigen zak steken. De vruchtgebruiker is geen eigenaar. De eigenaar heet: “de hoofdgerechtigde”. Deze wordt ook wel bloot-eigenaar genoemd, omdat zijn eigendomsrecht als het ware is uitgekleed en gunste van de vruchtgebruiker. Een vruchtgebruik ontstaat in sommige gevallen krachtens het wettelijk erfrecht, bijvoorbeeld in het geval iemand zijn echtgenote heeft onterfd. De wetgever wil niet dat een echtgeno(o)t(e) helemaal berooid achterblijft als iemand zo leuk is om zijn maîtresse tot enig erfgenaam te benoemen, en daarom kan de berooide echtgenote een vruchtgebruik van de echtelijke woning en de inboedel claimen. Een recht van vruchtgebruik kan ook in een testament worden opgenomen, bijvoorbeeld om iemand (meestal de langstlevende echtgenoot) het genot van het huis en de inboedel te legateren. De (stief)kinderen worden dan tot (bloot)eigenaar benoemd.
