Indien een echtgenoot door afwezigheid of een andere oorzaak in de onmogelijkheid verkeert zijn goederen of de goederen der gemeenschap te besturen, of in ernstige mate tekortschiet in het bestuur van de goederen der gemeenschap, kan de rechtbank op verzoek van de andere echtgenoot aan deze het bestuur over die goederen of een deel daarva met uitsluiting van de eerstgenoemde echtgenoot opdragen. De rechter kan bij de opdracht nadere regelen stellen omtrent het bestuur en de vertegenwoordiging in de zin van lid 4." The provisions in respect of mandate shall apply between a spouse who leaves the management to which he or she is entitled to the other spouse and the latter spouse, with due observance of the nature of the marital relationship and the nature of the þroperty. Article 91 1. If, as a result of absence or another cause, a spouse finds it impossible to manage his or her own property or the community property or, to a serious extent, fails to manage the community property, the district court may, at the request of the other spouse, order him or her to manage such property or a part thereof while excluding the first mentioned spouse. When giving such mandate, the district court may set further rules in respect of the management and representation within the meaning of paragraph 4."
