Child maintenance is not controlled. If a parent doesn’t comply, the other parent has to take initiative to enforce it.
Non-compliance is a legal offence in accordance with Art. 391b of the Criminal Code and could lead to imprisonment.

Other methods are:

Authority of receipt (=ontvangstmachtiging or loondelegatie): separated married parents can insert this in the divorce deed. It means that the maintenance can be deducted of the earnings of the non-resident parent in the case of non-compliance. The parent with care can also ask for this ‘authority of receipt’ after the divorce.

4. Loonbeslag is een beslag onder derden, een van de middelen van tenuitvoerlegging die kunnen aangewend worden wanneer een uitvoerbare titel voorhanden is. De procedure is geregeld in artikel 1539 e. v. Ger.W.

Zoals bij elk beslag, wordt hier een vermogensbestanddeel van de schuldenaar (een loonvordering) onder de macht van de justitie gebracht met het oog op tegeldemaking (hier afgifte) en verdeling onder de schuldeisers.
Voor alle geschillen is in het algemeen de beslagrechter bevoegd.

5. Loondelegatie is een gerechtelijke machtiging verleend aan een echtgenoot of een gewezen echtgenoot om de inkomsten van de andere (zijn loon), met uitsluiting van deze laatste, zelf rechtstreeks bij de schuldenaar ervan (zijn werkgever) geheel of ten dele in ontvangst te nemen.

De machtiging waarborgt de uitvoering van een solidariteitsverplichting of een verplichting tot onderhoud. Het toepassingsgebied is zeer beperkt. De gevallen en de procedures zijn geregeld in de artikelen 221 en 301bis B.W. en artikel 1280 Ger.W.

De uitvoeringsmodaliteit is in het vonnis zelf bepaald en beoogt onmiddellijke betaling zonder omweg van beslag en verdeling en verleent onder bepaalde opzichten aan de gemachtigde een werkelijke voorrang in geval van samenloop met schuldeisers.

6. Loonoverdracht is een overeenkomst waarbij het recht op het loon, zijnde een schuldvordering, afgestaan wordt tot zekerheid van een bepaalde schuld. De procedure is geregeld in de artikelen 27 e. v. van de Wet van 12 april 1965 en wijkt sterk af van het gemeen recht betreffende de overdracht van schuldvorderingen.

Deze afstand beoogt eigendomsoverdracht van het loon tot beloop van het bedrag van de schuld en onttrekt het loon aan het verhaal van de andere schuldeisers.
