Have you looked into the French legal term mémoire? The Council of Europe French-English Legal Dictionary's translation for this is "pleadings; statement of grounds of appeal". That would make "van cassatie" somewhat redundant if you typically translate "cassatie" as "appeal" or finagle it to "cassation", with the understanding that the latter is a term predominantly used only in European justice systems (e.g. French/Belgian/Greek/Bulgarian etc.). I typically avoid "cassation" in English b/c my clients always confuse it with "cessation" (and the dubious musical meaning in English). In any case, as for your target PHRASE, it stands to reason that "een memorie na cassatie en verwijzing..." could be translated as "a statement of grounds on appeal and referral" Seems to be supported by the WNT's definition 4 of memorie: "Geschreven stuk waarin van bepaalde zaken gewag wordt gemaakt; hetzij eene lijst, eene opsomming, eene opgave, eene beschrijving enz." US/CA would contain these items "on appeal and referral" (e.g. to a competent court) in an "appellate brief" or "appellant factum". I can't vouch for anywhere else (UK, NZ, AU). 'nemen van een memorie' is definitely a set phrase as well - nemen van een memorie van grieven - nemen van een memorie of akte - ...toestaan voor het nemen van een memorie of voor pleidooi. - ...nemen van een memorie van antwoord - In fact 'nemen van een memorie' seems to be the key phrase here 'nemen van een memorie' (na verwijzing van een zaak) -------------------------------------------------- Note added at 1 hr (2017-03-14 18:59:37 GMT) -------------------------------------------------- Het hof kan Adidas c.s. hierin niet volgen. De procedure na cassatie moet worden beschouwd als een voortzetting van de oorspronkelijke procedure.
