Reference Reference information: Wanneer het niet nodig is om de verdachte langer vast te houden (voorlopige hechtenis), wordt een andere procedure in het snelrecht toegepast. Deze procedure wordt ook wel ‘AU’ genoemd, Aanhouden en Uitreiken (van de dagvaarding). Daarbij krijgt de verdachte op het politiebureau direct de dagvaarding en vaak een schikkingsvoorstel (‘boete’) uitgereikt voordat hij naar huis mag. Gaat de verdachte in op het voorstel en betaalt hij op tijd, dan is de zaak afgedaan. Anders komt hij alsnog binnen een aantal maanden voor de rechter. http://www.wetrecht.nl/snelrecht-en-supersnelrecht/ In de tweede plaats is er sprake van een soort snelrecht, waarbij gestreefd wordt naar een snelle beslissing over vervolging van de verdachte, die veelal na betrapping op heter daad voor een eenvoudig misdrijf is aangehouden. Die beslissing wordt door het openbaar ministerie genomen terwijl de verdachte nog op het politiebureau verblijft. Daarna wordt de dagvaarding ter plekke in persoon betekend. In alle gevallen vindt overleg plaats tussen de politie en de officier van justitie; in de situatie waarin de officier van justitie niet op het politiebureau aanwezig is, ontvangt de verdachte de dagvaarding via electronische weg (per fax). Een belangrijk voordeel is dat de verdachte meteen uitsluitsel krijgt over het justitiële gevolg dat aan zijn zaak wordt gegeven.
