Dutch to English translations [PRO]
Bus/Financial - Real Estate
Dutch term or phrase: aflevering
My doc:

;**************************************************

I am translating "Juridische levering" as "transfer of title", but am stuck on "aflevering".

FELOnline has:

aflevering =
delivery
handover

feitelijke overdracht =
completion [property]

OGL:

aflevering = delivery

;**************************************************

Online, I found:

NL:

"Artikel 3
Er zijn verschillende soorten overdrachten.
De belangrijkste zijn de juridische en de feitelijke overdracht.

De juridische overdracht (ook wel juridische levering, eigendomsoverdracht of transport genoemd) vindt plaats bij de notaris via een notariële akte en inschrijving daarvan in de registers van het kadaster.

De feitelijke overdracht vindt plaats door het overhandigen van de sleutels en het in bezit nemen van het verkochte pand."

ENG:

"Article 3
There are various types of transfer.
The most important are the legal and actual, or de facto, transfer.

Legal transfer (also known as legal delivery or transfer of title) takes place at the notary’s office by means of a notarial deed and registration of that deed in the Land Register.

The de facto transfer takes place when the keys are handed over and the purchaser takes possession of the property he has bought."

=>

juridische overdracht = juridische levering = eigendomsoverdracht
vs
feitelijke overdracht

=

legal transfer = legal delivery = transfer of title
vs
actual transfer; de facto transfer

;**************************************************

So, in conclusion, my options seem to range between:

aflevering =

actual transfer
de facto transfer
handover
completion
delivery

Explanation:
Article 7 of the Dutch Civil Code describes the elements of purchase and sale in general, not particularly in relation to the delivery of fixed property. Terms specifically related to the delivery of fixed property, like conveyancing, transfer and registration, are therefore not applicable. "Delivery" or "transfer" are. (See definitions of conveyancing and delivery under web references, below.) "Delivery" is correct, as the most accurate translation of 'aflevering' - and, importantly, as a familiar and legally meaningful word, both in this context and to the (assumed) legal target audience.

--------------------------------------------------

In other words the source introduces a definition of "delivery", by reference to the Code, that is broader than the definition of delivery (by transfer of registration) specific to fixed property.

(a) In response to asker's comment - yes - I was actually referring to book 7 - not article 7, sorry. (And book 7 article 9 indeed concerns sale in general not just fixed property sale, as I mentioned in my answer.) (b) Error: delete "transfer' in second line of "Explanation".

Example sentence(s):
  • As an element of sale delivery may be actual physical delivery of movable goods or symbolic deliver via transfer of registration of ownership (conveyancing in UK English) of immovable goods.
