Un exécuteur testamentaire est une personne chargée par le testateur (personne qui va tester) de procéder à l'exécution du testament. Il est donc choisi par le testateur qui désire établir un testament afin de désigner ses héritiers testamentaires. Son rôle est notamment régi par les articles 1025 à 1034 du Code Civil : il fait l'inventaire des biens d'une succession, est responsable de sa gestion, veille à la bonne exécution du testament... Il s'agit en général de notaires rétribués pour cela. In het Nederlands heb ik volgende informatie gevonden : Het nieuwe erfrecht en de executeur-testamentair Naar verwachting zal op 1 januari 2003 het nieuwe erfrecht worden ingevoerd. Eén van de wijzigingen ten opzichte van het bestaande erfrecht betreft de regeling van de executele. Onder het huidige erfrecht kan men bij testament of bij codicil (een handgeschreven soort testament) een executeur-testamentair benoemen. Onder het nieuwe erfrecht zal deze persoon, die dan alleen nog bij testament kan worden benoemd, kortweg 'executeur' genoemd worden. peer agreement (net): +1certificat d'exécution testamentaire Explanation: Il semblerait que ce type de déclaration n'existe pas en droit français. Verklaring van erfrecht = certificat d'hérédité. Par analogie, je propose de conserver le terme "certificat". Certificat d'exécution testamentaire, car ce certificat atteste de la qualité de l'exécuteur testamentaire et, dès lors, des droits dont il est investi en cette qualité. Toutefois, d'un point de vue juridique, il convient de conserver le terme néerlandais en italique (pratique courante en droit - cf. site Internet figurant ci-dessous) ! Définition de la notion d'executele verklaring: "Een variant op de verklaring van erfrecht is de verklaring van executele. De overledene zelf kan in zijn testament of in een codicil bepaald hebben wie zijn nalatenschap zal afwikkelen; deze persoon wordt executeur-testamentair genoemd.
