اتفاقية الاستقالة هي ما يقابل عقد التوظيف لكن من ناحية الاستقالة؛ حيث يورد فيها بنود تتضمن عدم مقاضاة الموظف للشركة بسبب فسخ عقده بدون وجه حق أو بدون استلام مستحقاته، رد أي أدوات تنتمي إلى الشركة سبق وكانت بحوذته لحاجة العمل، عدم افشاء اسرار الشركة والعاملين بها، إلخ. ولهذا فهي تترجم إلى اتفاقية حيث أنها تمثل اتفاق كتابي بين الموظف والشركة على ذلك النوع من البنود.
