实体 ＝ 物质（相对于精神）的存在 （字典解释），为何要重覆？

好像将 ’牛奶’ 写成 ‘牛奶母牛乳液’ 一样的奇怪效果。

用 ‘具体’ 会容易引起疑心。presence 在银行规定用语包含性广，不光是地点而已，也包括实际经营＋被政府承认。

另外一个思路是，按我的“实体性存在” 翻译。就像鲁迅说的，世上本没有路，走的人多了，就成了路。如果大家都采用 “实体性存在” 的译法，并增进对这一译法的理解，主要是对“存在”一词的理解，那么或许时间长了，可能会觉得我的译法也是很自然的。

其实，presence 翻译成“存在”可能更精确一些，但是考虑到文化差异，可能难以为一般中国人所接受，其他的任何一个中文词似乎都难以准确传达 presence 的含义。

翻译成“营业地点” 其实已经包含了营业活动。

按我的理解，physical 就是指物质性的营业设施以及人员。

你的分析很不错，非常详细和深入，只是觉得教育（及移民 e.g. requires the physical presence of the immigration applicant in USA）方面的用法和译法，与银行法例方面，有很大不同。我之前引用中国招商银行依照美国《爱国者法案》的声名’ USA Patriot Act 2001，里面有与 Eureka 相似的原文，提到 physical presence 于银行界的定义：

Physical presence of the foreign bank "has a place of business... and employs one or more individuals on a full-time basis and maintains operating records related to its banking activities."

整个含义不光是有一个营业地点而已，而是包含实际营业运作，包括雇用起码一个雇员及保存有关银行作业的纪录，并获得当地政府批准进行银行业务。

基于以上理解，如果只翻译成 “没有具体营业地点”，不是错误，只是好像有点不足够。因为你可以坚持说我没有具体的营业地点，却在多个不同地方进行实际银行业务。

看了 Lin 兄和Jacky 兄前面的讨论，感觉这个问题有点复杂，不过，还是想尝试探讨一下。我觉得 Lin 兄和 jyuan兄 的译法都有合理的成分。
我觉得 physical 这里的意思是：of or relating to things perceived through the senses as opposed to the mind; tangible or concrete 《新牛津英汉双解大词典》，意思就是物质的、有形的、实体的、具体的。

相信原文与这个例句一样，是关于海外银行在某国营业的条件或法律，不是关于虚拟实体 virtual reality (e.g the Internet) 或 虚拟经济 virtual economy 的问题。所以，个人觉得硬将不同领域的词语套在不同行业用词上，有点不太恰当，同时也间接将中文原义歪曲了。

根据原文语境，个人觉得译成 ’实际营业‘ 较符合原文表达含义。

只是讨论一下 ’实体‘ 的用法。

实体 （名词）＝1。马克斯主义以前的哲学的一个概念，认为实体是万物不变的基础和本原。唯心主义者所说的’精神‘、形而上学的唯物主义者所说的 ’物质‘ 都是这样的实体。

2。 指实际存在的起作用的组织或机构：例如：经济实体，政治实体。

－ 《现代汉语词典》第五版

上面词典的第 1 个解释 ＝ substance; 第 2 个解释 = entity

e.g. economic / political entity

两个解释都好像没有 physical presence 的含义。勉强用第 2 个解释来套在原文上则不合语法。

J.H. 建议译成 ’实体存在‘ 。如果根据词典的解释，好像有点重覆了，因为一个实体其实已经包含了’存在‘ 的意思，实在无须重覆。

而 Jacky 的 ’实体机构‘，其实也好像重覆了实体原来已经有 ’机构‘ 的含义。

所以个人觉得用 ‘实际’ 会较合原文意思。不用担心会将 ‘实体’ 的词典原义歪曲或重覆。
