In deze context gaat hem om een mededeling aan alle medewerkers verkoop en marketing, en in een van de headers staat: "Privileged and Confidential: Attorney-Client Communication".

Alle personeel wordt opgeroepen melding te maken van eventuele bespreking of het lekken van informatie over prijzen of andere vertrouwelijke zakelijke informatie, of het getuige zijn daarvan, omdat een concurrent precies tegelijkertijd zijn prijs heeft verhoogd, gelijk aan die van het bedrijf.

De gegeven informatie stelt even verder dat niet alle landen (waaronder veel landen in Europa) "recognize attorney-client privilege for communications with in-house attorneys. Consult the legal department to understand these rules."

Wat wordt hiermee eigenlijk precies bedoeld, dat het recht op privécommunicatie tussen advocaat en cliënt niet overal wordt erkend? Hoe dan ook, het is fout om opnieuw met de concurrent te gaan praten als je hier zelf bij betrokken of getuige van was, en het is ook fout om maar niks te zeggen. Maar kennelijk is ook niet alle privécommuncatie met de advocaten beschermd?

Ik had "privileged and confidential" vertaald met "persoonlijk en vertrouwelijk" met het idee dat persoonlijk impliceert dat het beschermd (ongelezen door derden) betekent. Is dat correct, of moet ik iets anders kiezen?

Asker: Hi Sindy, bedankt. Ik zie (linguee) dat dit (privileged and confidential) toch dikwijls vertaald wordt met alleen maar vertrouwelijk. Het hangt natuurlijk van de context af, maar in juridische context impliceert vertrouwelijk in NL ook geheimhouding. Of niet? Privileged lijkt oorspronkelijk te komen uit postverkeer van geïnterneerden, of zie ik dat verkeerd?

agree  writeaway: the actual term is attorney-client privilege. It can't really be separated if the meaning is to be clear. privilege on its own has lots of meanings.
