The “mere conduit” defence, relied on by Mr McFadden, arises where three cumulative conditions are met: (i) the provider of the mere conduit service did not initiate the transmission; (ii) the provider did not select the recipient of the transmission; and (iii) the provider did not select or modify the information contained in the transmission. The Munich Regional German Court believed these conditions had been satisfied in the present case, but was uncertain as to whether Mr McFadden was a “service provider” providing an “information society service” (defined as services “normally provided for remuneration”) within the meaning of the Directive."

Explanation:
conduit something which leads something else along. In the law of European E-COMMERCE, a person who is given special immunity, sometimes expressed as a ‘mere’ conduit importing a lack of involvement in the carrying. Most likely it will apply to an Internet service provider. Where an information society service is provided which consists of the transmission in a communication network of information provided by a recipient of the service or the provision of access to a communication network, the service provider (if he otherwise would) is not liable for damages or for any other pecuniary remedy or for any criminal sanction as a result of that transmission where the service provider:
(a) did not initiate the transmission;
(b) did not select the receiver of the transmission;
(c) did not select or modify the information contained in the transmission. Acts of transmission and of provision of access include the automatic, intermediate and transient storage of the information transmitted where this takes place for the sole purpose of carrying out the transmission in the communication network, and the information is not stored for any period longer than is reasonably necessary for the transmission.
