The “mere conduit” defence, relied on by Mr McFadden, arises where three cumulative conditions are met: (i) the provider of the mere conduit service did not initiate the transmission; (ii) the provider did not select the recipient of the transmission; and (iii) the provider did not select or modify the information contained in the transmission. In the law of European E-COMMERCE, a person who is given special immunity, sometimes expressed as a ‘mere’ conduit importing a lack of involvement in the carrying. Most likely it will apply to an Internet service provider. Where an information society service is provided which consists of the transmission in a communication network of information provided by a recipient of the service or the provision of access to a communication network, the service provider (if he otherwise would) is not liable for damages or for any other pecuniary remedy or for any criminal sanction as a result of that transmission where the service provider: (a) did not initiate the transmission; (b) did not select the receiver of the transmission; (c) did not select or modify the information contained in the transmission.
