IOW unless it's going to be used by the Defendant, this "paragraph A" (or the whole document containing it - again: context needed!) will be considered as irrelevant to the case.

This is a scenario where there is no need to twist the neck of the meaning of "save", but then again - more context is needed to be sure of the right formulation in FR!

and to point to be blindingly obvious, this would have been a quote from what the trial judge said, as it's not up to the Defendant to decide what is or is not relevant/admissible!
