agree  Germaine: Je n'en vois pas tant que ça, si l'on tient compte du fait que "L'obligation de diligence est l'un des cinq éléments composant le délit de négligence" (!), mais dans le doute, c'est ce que j'utiliserais ici.

I think that you need to slightly rephrase the whole sentence "the tort of negligence" is just an abstract concept, and basically means that some obligations (here "the duty of care") were ignored NOT the other way round that the "tort of negligence" would somehow create an obligation of "duty of care"!

What is implied is: as part of the action / claim based of the "tort of negligence" one party contented that there was a "duty of care" (definitely had to, otherwise there wouldn't be possible to claim any "negligence" )
