Hello,

I am reviewing a contract for a biomass Facility and there is this part, in section Fees (Honoraires) :

(b) if there are insufficient funds available (in receivables account), the liability of the Owner to pay to the Operator such receivables and outstanding debt as referenced in (a) above, shall enjoy super-senior status and the Parties shall discuss in good faith any amendments to existing contracts or security arrangements to give effect to such status.

SUPER SENIOR STATUS ?

Existe t-il un lien de supériorité hiérarchique ? En gros, si le Propriétaire de la Centrale n'a pas de fonds suffisant dans ce compte dédié pour payer l'Opérateur, il sortira la carte "je suis le patron" et de ce fait, on va discuter et essayer de trouver un arrangement.
