Bonjour à tous,

Dans un contrat de vente d'un bien immobilier "cross-lease" apparaît à plusieurs reprises. Je crois comprendre l'idée générale après avoir fait des recherches mais je n'ai aucune idée de la manière de traduire ce terme.
Il apparaît notamment dans une liste de cases à cocher pour qualifier le bien : Freehold, Leasehold, Cross-lease (Freehold), Cross-lease (Leashold) ou encore dans l'expression "cross-lease title" par opposition à "unit title".

A cross lease is where a number of people own an undivided share in a piece of land and the homes that they build on the land are leased from the other land-owners (normally for a term of 999 years). The houses are usually flats or townhouses. The implications of being on a cross lease are that, when you are making major structural changes to your property or making changes that could affect the flats plan on the certificate of title, then as well as approaching the local authority, you’ll need the other owners in the cross lease to provide their written approval. Another disadvantage is the decision making process around common area (access, outdoor amenity areas etc) must be made in consultation with the other owners and all must be in agreement.

Explanation:
I'll leave Ph-B to post 'copropriété horizontale/ copropriété du sol', though the Swiss system of co-ownership is worth taking a look at.

A ProZ web ref translates the term into German as eine grenzüberschreitende Pacht, so mistakenly as a cross-boundary or cross-border = international franchise or rental, but the 999-year 'virtual-freehold' makes me think of a US-type condo or, rather, a UK-type commonhold under which a lease extended from 99 years is granted. In this case, the grant is also a building lease.

  -> Thanks, Chris. It's a shame ph-b, and Germaine on the back of Canadian strata title, didn't post their own answers. The answer chosen seems to have conflated the jointly-owned freehold with the leases carved thereout - like my commonhold in West London.
