disagree  AllegroTrans: NO it has a much more specific meaning --- "frais de justice" simply means "costs" but does not cover the concept of "order for costs in case"

  -> Why not, maybe more context is needed, but even in your example "costs will be paid by the side which loses the trial", how would you translate those costs into French if not by "frais de justice", maybe "dépens" would fit as well then ?
