I am not a lawyer, so please, verify the accuracy of my suggestion before using it. I understand the "incidence of liability" as some degree of liability that is agreed upon in a contract or such. Here are a few excerpts from texts on the websites quoted that may steer you in the right direction: "The Law Society model requires that the parties exchange essential information and position statements early in the pre-trial period, after which the ENE session takes place which typically lasts three hours. The evaluator may ask questions and help the parties identify the main issues in dispute as well as areas of agreement. He or she offers an opinion as to the likely incidence of liability and where appropriate, a range of damages." http://www.lawsocnsw.asn.au/practice/mediation_kit/mediation... "'Sec. 4.6. The commission herein established in a body corporate and politic, separate and distinct from the party states and shall be so liable for its own actions. Liabilities of the commission shall not be deemed to be liabilities of the party states, nor shall members of the commission be personally liable for action taken by them in their official capacity. The commission shall not be responsible for any costs or expenses associated with the creation, operation, closure, postclosure observation and maintenance and institutional control of any regional facility or any associated regulatory activities of the party states. Except as otherwise provided herein, this compact shall not be construed to alter the incidence of liability of any kind for any act, omission or course of conduct. Generators, shippers and carriers of wastes and owners and operators of sites shall be liable for their acts, omissions, conduct or relationships in accordance with all laws relating thereto. " http://ssl.csg.org/compactlaws/northeastlowleverlradioactive... " http://www.lexum.umontreal.ca/fr/texte/contrat.html Does that make any sense? |
