En France, contracter un mandat d’exclusivité avec une agence immobilière engage un propriétaire à ne traiter qu’avec cette agence. C'est donc un contrat entre l'agence immobilière et le propriétaire du bien, le compromis de vente se signe entre le vendeur du bien et l'acquéreur. C'est une deuxième étape. Une fois signé le compromis, on ne peut pas faire marche arrière. Il s'agit de deux documents différents.

In the UK, the equivelent of a "mandat d'exclusivité" only restricts (or restricted?) WHO could sell it, not TO WHOM. I.e. a seller could get a firm offer through the agent, accept it, then find the agent was still talking to other potential buyers who were prepared to pay more. It's tempting for everyone (except for the initial buyer who finds the property snatched away - even if the full asking price was offered!). That can't happen in France, whatever the form of "mandat" - other buyers are locked out by the "compromis".

I know from personal experience that in the UK there has been a lot of trouble with gazumping, whereas in France the pre-sale contract makes it a virtual impossibility. Gazumping can happen even with an exclusive estate agent's mandate (e.g. private contact) if the prospective buyer and seller have no contract.
