Kumulative Rechtsmittel Explanation: From my - somewhat limited - practical experience with distributors and distribution agreements, I would suppose the company X reserves the right to do several different things in case of a fault of the distributor (e.g. in case of late payment: block open orders, cancel the distributor agreement, claim a penalty(Konventionalstrafe) of a couple 1000 $, and in addition to that, engage legal action to recover the money. So they are doing several things (using several remedies) of their own to get their dues one in addition to the other and to the legal action (cumulative). Basically, if a company has distributors, it needs one person to do price quotations, process orders, provide technical advice, and one person to take care of the legal aspects of distribution agreements, resolve disputes of different distributors infringing each others rights/territories, chase payments etc. I used to be the person for the technical issues and quotations... |
