I am looking at EN>DE legal questions by a sheer fluke this morning - pace EN-into DE-colleagues and used to work in probate/ (Scots law) confirmation of Will during the era of Capital Transfer Tax - not only on Grunderwerbe (see the 2nd web ref.) but also on transfers of money - under a UK Labour Government and that had been split, under a Conservative one, into lifetime capital transfers and inehritance tax mortis causa/ on death.

I am sure transfer in this case, nowadays, means lifetime transfers (inter vivos), namely in the (UK) deceased/ (US) decedent-testator-testatrix dies within 7 years of making a lifetime transfer to a beneficiary, the UK Revenue & Customs will 'claw back' (Steuerrück- bzw. -nachforderung) pro rata temporis or on a 'time-apportioned basis' the IHT/Inheritance tax that then becomes payable.

Gross estate is the Gesamterbmasse bzw. Bruttonachlaßvermögen ? *before* payment of taxes and Council Tax, testamentary executors' /personal representatives- bank's or lawyers' fees as (pre-)preferential creditors and specific legacies (Zweckvermächtinisse?) #charged on the gross estate before division#.

Residuary estate is the one going to the residuary heirs (Universalerben bzw. Erbgemeinsschaft! - City of London AT/CH/LI/DE) notarial translation) after payment of such.

I am praying for such well-informed comments as 'the two: English and German systems are completely different so can and should not be compared!'
