All I know and write on this 'Forum' is what I know in my Academic life of over 60 yrs. in an English environment in England. So, what I write is what I speak with the English people. Φυσικά και θα μεταφράσεις «στο εξής» το hereinafter. Απλώς ο transphy δυσκολεύεται να καταλάβει τι του γράφω και επιμένει να νομίζει ότι τώρα μαθαίνω αγγλικά. Βάλε "θεμελιώδες ερώτημα" — το οποίο είναι θέμα ουσίας, φυσικά, αλλά το threshold δηλώνει το κατώφλι που πρέπει να διαβείς για να πας παρακάτω. Στην απόφαση για την επίλυση διαφορών η επιτροπή πρέπει πρωτίστως να λάβει υπόψη τις προϋποθέσεις για την εφαρμογή κάποιας διάταξης της CTA, όπως αν κάποιος είναι μόνιμος κάτοικος κλπ.

ο όρος επαναλαμβάνεται στη συνέχεια και καλείται η επιτροπή διαιτησίας να λάβει υπόψη της στην απόφασή της για την επίλυση διαφορών αυτό το "threshold question".
Επειδή πρόκειται για επίσημη πολυμερή σύμβαση τον όρο 'hereinafter' τον μεταφράζω συνήθως 'στο εξής ' ή 'εφεξής" . Τώρα, για το επίμαχο ζήτημα αν είναι αμφιταλαντεύομαι μεταξύ του... θεμελιώδες ερώτημα ... θέμα ουσίας ....το ουσιώδες ζήτημα ή ερώτημα. Θα συνεχίσω τη μετάφραση και μέχρι τις 100 σελίδες μπορεί να το συναντήσω ξανά και να είναι πιο ξεκάθαρο.

@ Nick. Δεν είναι το 'hereinafter' ν' αναφέρεται σε κάτι που 'προηγείται', προς Θεού!!
Σημαίνει, κατι που ακολουθεί εδώ, το ακόλουθο, το εξής, το παρακάτω......

Το "hereinafter" αναφέρεται σε κάτι που προηγείται (μάλλον το "an issue regarding the conditions for application of a provision of the relevant Covered Tax Agreement") και όχι σε κάτι που έπεται. Το "whether an individual is a resident or whether a permanent establishment exists" είναι παράδειγμα ("such as...").

The 'hereinafter' (το ακόλουθον εδώ) αναφέρεται στη διφορούμενη /αμφίβολη/αμφισβητούμενη πρόταση του αν, '.... an individual is a resident or whether a permanent establishment exists". Δηλ. αν, νομικώς, θεωρείται κάτοικος ή όχι. Ίσως και αν ονομαστεί ' 'αμφίβολη ερώτηση' το 'threshold' κρατάει.

Εδώ είναι μια άλλη συνηθισμένη σημασία του threshold, που αποδίδεται σαν «όριο». Στο δικό σου κείμενο, το hereinafter υποδηλώνει επανεμφάνιση του όρου στο κείμενο. Αν τον βλέπεις και παρακάτω, δες αν ταιριάζει η πρότασή μου ή το μάλλον πιο περίπλοκο που αναφέρεις (που είναι και πιο δύσκολο στην απόδοση, αλλά και πιο αδιαφανές στο πρωτότυπο).
