Meanwhile, in response to a circular to creditors from COMPANY Y dated 01/01/01, COMPANY X had disputed the credit of COMPANY Y in a letter with a spreadsheet showing the correct ledger which showed a net balance in credit to COMPANY X against COMPANY Y in the sum of EUR 123456. In order to settle this position, COMPANY X would like to make a without prejudice offer to COMPANY Y as follows:

"COMPANY X will agree ****to write off its claim for the net sum of EUR 123456***** against COMPANY Y"
COMPANY Y will agree that it has no outstanding financial claim against COMPANY X.
