Explanation:

The meaning of "asserting party" is that the party declares to be intitled to certain privileges - or that the opposing party isn't intitled to - in the procedure.

In this particular case it MAY also be the"parte lesa", but that's not the strict meaning of the expression.

(and parte lesa of course does not apply to every case of an asserting party...)
