The flaw with this theory, though, is the timing -- why now? Federal courts aren't that much busier today than they were three or four years ago, or even seven or eight years ago for that matter. Why would the Court take such exception with overreliance by the lower courts in these cases today, as opposed to three, four, or ten years ago?
