Law/Patents - Law (general) / docket clearing
English term or phrase: docket clearing
While the criteria used by the judiciary in evaluating its members are not public, efficient docket-clearing is an important factor. So, it seems, is not embarrassing the judiciary as an institution.

The first theory is perhaps the easiest explanation -- that lower courts, owing to mounting pressures on their dockets, have relied on unconventional and/or strained readings of both the jurisdictional statutes and doctrinal exceptions as docket-clearing devices.† This claim, for example, has been made time and again in reference to why Rooker-Feldman was so popular for so long in the lower courts. The flaw with this theory, though, is the timing -- why now? Federal courts aren't that much busier today than they were three or four years ago, or even seven or eight years ago for that matter. Why would the Court take such exception with overreliance by the lower courts in these cases today, as opposed to three, four, or ten years ago? Docket-clearing, on its own, doesn't seem to do enough.
