peer agreement (net): +2| without prejudice except as to costs 弁護士秘匿特権適用書類（費用に関する部分は除く） Explanation: Hi, my answer might be a bit late but I can explain the background of 'without prejudice as to costs'. 'Without projudice' part is designed to keep the document from court or the other party's review during proceedings. The purpose is is to keep the confidentiality of the lawyer and the client's communication to protect the lawyer's business and the client's interest (e.g. criminals do not want the prosecutor to examine documents which record his/her conversation with his/her attorney). 'except as to costs' is added so that the court or the other party in the court proceeding may refer to the cost part ONLY on the document when making a cost submission at the end of the case (either party would be able to recover the costs incurred (incl. attorney's fees) or need to bear his and the other party's costs if so ordered). By putting 'except as to costs', the party can claim at the cost hearing by submitting that document totally blacked out except the cost part so the judge can opine on the level of the fees incurred for the litigation (and may enter a judgement in his favour by ordering the other party to pay that fees!).
