Section 4(1) provides that a “relevant disposal” is a disposal by the landlord of any estate or interest in any premises to which Part I of the Act applies. The “landlord” for these purposes is the immediate landlord of the qualifying tenants, who is obliged to serve a notice under sections 5 to 5E offering the tenants the right to enter into the proposed transaction. (1)A disposal, whether of the whole or part of the dwelling-house, is a relevant disposal for the purposes of this Part if it is— (a)a further conveyance of the freehold or an assignment of the lease, or (b)the grant of a lease (other than a mortgage term) for a term of more than 21 years otherwise than at a rack rent.
