Principalmente porque existe uma grande diferença no direito brasileira entre "tutela" e "curatela", o que não é diferenciado pelo termo "guardianship".

Encontrei uma "CONVENÇÃO INTERAMERICANA SOBRE A RESTITUIÇÃO INTERNACIONAL DE MENORES" que utiliza os termos acima citados.
