"Za odgovarajuću (ponuđenu) protivvrednost / naknadu, za koju ovim potvrđujemo da smo je primili i da je po zakonu dovoljna, mi smo se saglasili da: ....

"consideration" kao koncept iz anglosaksonskog prava koji se primenjuje kada su pitanju ugovori u bilo kakvom obliku trgovine = "ponuđena protivvrednost – naknada" - (nema apsolutno nikakve veze sa moralom, etikom ili sa "being considerate"),

"valuable / good consideration" = ono što jedna ugovorna strana nudi drugoj u razmenu mora imati neku vrednost, bilo kakvu vrednost; ugovor je ništav ako je ponuđeno nešto bezvredno - doslovce "ponuđena naknada od neke vrednosti".

Da li je ono što je ponuđeno od bilo kakve vrednosti procenjuje primalac: "a consideration is a good consideration" ako onaj koji prima naknadu / protivvrednost smatra da to njemu/njoj nešto vredi, u tom smislu je ponuđena protivvrednost "odgovarajuća"

Explanation:
For G&VC ,... на почетку уговора је фраза која нема еквивалент у српском језику. Смисао је, укратко, да се стране које потписују уговор обавезују да ће извршити размену нематеријалних/материјалних добара (услуга, чињења, нечињења), да су се претходно сагласили око вредности добара која размењују, а све у складу са законом. Ем нема адекватан еквивалент у српском, ем се све то подразумева код уговора. Ја то не бих преводила.
Иначе, мислим да good (consideration) овде нема везе са робом. Па и даље, само good consideration би требало да буде нематеријална, морална накнада; нешто што се чини не зарад размене/користи, већ из љубави, наклоности, због самилости...

Ако би желели да преведемо ову фразу на начин који би био примењив приликом превођења сваког уговора, а да при том превод не направи конфузију, онда ту треба решити неколико проблема.

Прво – the receipt. Мислим да се овде не ради о потврди да је уговорна страна већ примила накнаду. Јер, шта ћемо са уговорима где је наплата тек у форми обећања да ће се реализовати, и управо тај уговор то обећање треба да учини обавезујућим? А, готово сваки уговор је такав. Зато сматрам да цела ова уводна фраза има за циљ да да до знања да су уговорне стране свесне и сагласне да оно што желе да размене има вредност, да су сагласне да то што размењују има управо онолику вредност како су утврдили, да прихватају размену онога што једно другом нуде (наравно, све то ако је реч о двострано теретном уговору), где би управо та размена, односно противуслуга друге стране као адекватна вредносна накнада, могло бити то the receipt (у смислу да се потврђује да се та противуслуга прихвата као наплата), те увереност да је то што једна другој нуде, као и сама размена – правно ваљано (legal sufficiency), и стога тај договор желе да учине обавезујућим, а на начин како даље детаљно следи у уговору. Дакле, сматрам да the receipt никако не може бити ''накнада коју сам примио''.

Друго – сматрам да уговорна страна нема тај капацитет да ''потрвђује'' да ли је нешто по закону ваљано/довољно.

Да скратим, мислим да би најбезболнији превод био отприлике овакав:

Будући да се овим потврђује да свака уговорна страна сматра противуслугу друге уговорне стране вредносно одговарајућом и правно ваљаном накнадом, и као такву је прихвата;

Ја, доле потписани, сагласан сам како следи....

This wording is so much verbiage, and should usually be avoided. We like to introduce the operative part of a contract with words such as The parties agree as follows.
