Trast uspostavljen po smrti/ osnovan za slučaj smrti

U angloameričkom pravu postoji vrlo širok spektar različitih vrsta trastova koncipiranih za različite potrebe. Njih je moguće klasifikovati u brojne kategorije po različitim kriterijumima. Jedan od su trastovi koji nastaju uz izričitu volju njihovog osnivača – tzv. 'express' trastovi, koji se mogu osnovati za života ili za slučaj smrti (living trusts, testamentary trusts). Trastovi se mogu osnovati u korist određenih beneficijara, među kojim sme da bude i sam osnivač i/ili članovi njegove porodice, dakle u korist pojedinaca, a ne u korist zajednice (private trust)

Odnosno, moglo bi i samo: testamental(r)ni fond, ako ono „starateljski“ možda dovodi do neke zabune.

Asker: Video sam između ostalih i ovu definiciju na investopediji, ali nisam shvatio koncept na engleskom, sad mi je malo jasnije već. Hvala :)

disagree  Daryo: "starateljski fond" maybe makes sense in that specific occurrence for the sake of simplicity, but NOT ALL beneficiaries are always minors / or in need of "guardianship" - nothing stops beneficiaries from being adults, perfectly "legally capable".

  -> „Staranje, starateljstvo“ u srpskom nikako ne znači isključivo „...nad maloletnicima, „legally incapable“ licima i sl. Ovde se „testamentary trust“ stara (znači, ima starateljsku ulogu) o nasledstvu po testamentu – i šire od navedene ref.
