Querría conocer vuestras opiniones sobre mi propuesta de traducción de estas expresiones. Pero antes:

1) Este es el contexto. Son preguntas de un formulario, para determinar si uno puede considerarse o no residente en EE. UU. a efectos fiscales.
How many days were you physically present in the U.S. in the first year before the current year?
How many days were you physically present in the U.S. in the second year before the current year?

2) Hay que saber que, según las autoridades fiscales de EE. UU. (IRS), para ser considerado residente a esos efecto.... Copio el extracto de la página del IRS, atención al ejemplo.

You must be physically present in the United States on at least:
31 days during the current year, and
183 days during the 3-year period that includes the current year and the 2 years immediately before that, counting:
All the days you were present in the current year, and
1/3 of the days you were present in the first year before the current year, and
1/6 of the days you were present in the second year before the current year.
Example:
You were physically present in the United States on 120 days in each of the years 2010, 2011, and 2012. To determine if you meet the substantial presence test for 2012, count the full 120 days of presence in 2012, 40 days in 2011 (1/3 of 120), and 20 days in 2010 (1/6 of 120).

Según se ve en el ejemplo, el FIRST YEAR (2011 en el ejemplo) es más reciente que el SECOND YEAR (2010 en el ejemplo).

3) Por eso, esta es la traducción que se me ocurre, ¿qué os parece? ¿Otras ideas? ¡Muchísimaas gracias!
¿Cuántos días estuvo físicamente presente en los Estados Unidos en el último año inmediatamente anterior al año actual?
¿Cuántos días estuvo físicamente presente en los Estados Unidos en el penúltimo año inmediatamente anterior al año actual?

Explanation:
Las palabras "fisicamente" e "inmediatamente" resultan innecesarias por estar sobreentendidas, la primera por el contexto y la segunda por lógica temporal.

"¿Cuántos días estuvo (usted) presente en los Estados Unidos (de América) durante el año anterior al actual?"
"¿Cuántos días estuvo (usted) presente en los Estados Unidos (de América) durante el año anterior al año pasado?"

Tratándose de un documento oficial de inmigración, entiendo que es conveniente incluir el "usted" y el "de América", para evitar alegaciones de ambigüedad.

Tienes razón, Rebeca, es redundante en ambos idiomas (en principio toda presencia es física) pero puede evitar que se alegue que mantener una cuenta bancaria, por ejemplo, es "estar presente" (¿como persona jurídica?).

En todo caso debería opinar un abogado, pero a falta de eso mejor conservar el término y evitar el riesgo.

Asker: Muchas gracias, Wolf, me gusta tu propuesta, porque tienes razón, dado que son 3 años consecutivos y uno es siempre el actual, por qué no usar (año anterior al) año pasado. En cambio, aunque suene redundante, uso de manera consciente "físicamente presente" porque también en inglés lo hacen, o sea, son redudantes, y creo que es intencionado, para que no quepa ambigüedad de que se considera "estar presente" en un país a estos efectos.

Asker: Exacto, Wolf, tú lo has dicho, ese era mi temor... :-) Por desgracia el plazo que me dan es tan justo y el volumen tan extenso, que consultar a abogados es un sueño imposible ;-) Fíjate, tampoco he puesto (al menos, de momento) "usted" explícitamente porque, bueno, desde el inicio se ve que son preguntas directas, dirigidas a quien rellena el formulario, (el sujeto no es una tercera persona), y como ese uno podría ser una sociedad, un colectivo (persona jurídica) claro, ¿no es raro llamarlo "usted"? En esas me veo ... ¡Gracias y buena tarde! :P
