withold the sum claimed Explanation: The Principal can only refuse to pay the sum claimed in the defined circumstances. -------------------------------------------------- Note added at 22 mins (2012-10-22 08:08:48 GMT) -------------------------------------------------- The Principal may only offset any claims made by the Contractor or assert a right to withhold any claim if the counter-claim of the Principal is undisputed or irreversible. I think it does. He can only offset or withhold if there is no disputed claim by the Contractor against him or if his counter-claim has already progressed so far that the court has found in his favour and no appeal against this is possible. In answer line, "withhold", not "withold". |
