Hello everyone,

§ 52. Other provisions

Otherwise the provisions of the Execution of Sentences Act shall apply as far as it is compatible with decisions regarding restrictions or isolation pursuant to the Criminal Procedure Act, section 186 and 186 a. §§ 12, 15, 16, 20, 33, 35, 36 and 41 to 45 in the Execution of the Sentences Act do not apply.

The above sentence seems rather convoluted to me and though I understand each separate word I'm not sure I understand correctly the meaning of the whole sentence,

My understanding is as follows:

In other cases, the provisions of the Execution of Sentences Act shall apply as far as they (the provisions) are compatible with decisions regarding restrictions or isolation pursuant to section 186 and 186 a. §§ 12, 15, 16, 20, 33, 35, 36 of the Criminal Procedure Act and sections 41-45 of/in the Execution of the Sentences Act (in those other cases) do not apply.

Try this as a revised interpretation:

In other cases, the provisions of the Execution of Sentences Act shall apply as far as it (= the Act) is compatible with decisions regarding restrictions or isolation made under sections 186 and 186a of the Criminal Procedure Act.

New sentence:

§§ (= usually 'sections') 12, 15, 16, 20, 33, 35, 36 and 41–45 in the Execution of the Sentences Act do not apply.

The implication is perhaps that the rest of the EotSA is expected to be mainly compatible, but that these particular sections are not to be applied.

You can of course check and see if each of these Acts does indeed have the corresponding sections, and whether or not the application / non-application of them in this way would seem to be logical.

If you check the relevant Acts, the CPA does indeed have sections called 'sections', and there is a section 186 and 186a; neither of these, however, has subsections numbered as shown.

However, the EotSA has sections labels as '§', and does indeed have all the various sections listed.

disagree  airmailrpl: I can't agree with this interpretation, it would appear that §§ 12, 15, 16, 20, 33, 35, 36 are paragraphs of section 186 a.
