Hello.

I have problems for understanding the last phrase in the following paragraph (in a Marriage Certificate from the State of North Carolina):

“To any ordained minister of any religious denomination authorized by his Church, or Magistrate, you are hereby authorized at any time within 60 days from the date hereof, to celebrate the proposed marriage at any place within the above named county. The minister or other person celebrating this marriage is required within 10 days to fill out and sign both copies of this Certificate of Marriage, and return them to the Register of Deeds who issued the license. ***Failure to do so subjects person celebrating the marriage to a forfeiture of $200.00 to anyone who sues for the same***.”

I believe that
“forfeiture” = fine
“sue for” = apply for, and
“the same” = the certificates

but I cannot understand the full phrase.

If I am correct in my assumptions,
who imposes the “forfeiture” and who pays for it?
The person who celebrates the marriage, or that who applies for the certificate?

Any help, in English or Spanish will be highly appreciated.

Explanation:

if the minister or justice of the peace does not register the marriage legally within ten days he/she will have to pay $200.00 to the bride/groom who sues (takes them to court for not having registered the marriage)

sue = applies for/makes a claim for
the same = the failure to do what was required (or, perhaps, the $200)

Failure by the marriage celebrant to fill out, sign and return the Certificate of Marriage to the Register of Deeds within 10 days (of the marriage taking place I guess) means the celebrant (by law under the conditions of the certificate)will have to pay $200 to anyone who sues for the money (or for the failure)
