French term or phrase: Les parties selon la participation
Hi all,
I am not really sure what "selon la participation" means here.
"Les parties selon la participation reconnaissent mutuellement la capacité légale suffisante pour s’obliger dans les termes du présent document à respecter librement cet accord."

neutral  Tony M: I suspect it is more along the lines of '...selon la participation [de chacune]...", so probably more likely 'their participation'.

agree  Eliza Hall: If you change "the" to "their," I agree, this is probably it. Context/more source text would throw light on this question, though.

The parties, according to the share held/the partnership interest

Explanation:
'Context is everything' - this speculatively a *quota-share* reinsurance treaty [Tony M. > de chacune], joint-venture or partnership agreement.

If a contract of letting, then we would drift into the realms of 'privity of contract or estate' cf. 'effet relatif'.

Example sentence(s):
  • A quota share treaty is a pro rata reinsurance contract in which the insurer and reinsurer share premiums and losses

  -> Thanks and merci, Tony!

neutral  Daryo: the ONLY 2 ghits for "se reconnaissent mutuellement la capacité légale suffisante" have nothing to do with any kind of "partnership" - a bit worrying? you wouldn't expect these kind of contracts to be particularly secretive?

  -> It's possible that 'Les parties selon la participation....' is an odd wording for ès-qualités, so in that capacity whilst I am surprised that you are using g/hits as a benchmark for original drafting techniques in any language.

neutral  Eliza Hall: I doubt it is this narrow. https://www.dictionnaire-juridique.com/definition/participat...

I think those translating this with reference to shares may be committing an anglicism. https://www.merriam-webster.com/legal/participating
