(It’s from Congo (Kinshasa). The person was remanded by virtue of a complaint filed with the prosecutor’s office. I understand that this is more than “liberté provisoire”.. Shouldi understand it to be the same as a “classement sans suite”, because it’s as if the reason for detaining the person is no longer there (...ne subsistent plus).

Asker: Hi Adrian, thanks for your answer. Im not sure about the habeas corpus aspect as the suspect has not requested to appear before a judge but rather the prosecutor simply discharged his detention order. The case is still at the prosecutor’s office in the prejurisdictional stage.

§5. LES ACTES DE LIBERATION DE L'INCULPE

a. L'ordonnance des mainlevées de la détention.
Aux termes de l'article 44 du code procédure pénale, « lorsque le ministère public décide qu'il n'y a pas lieu de poursuivre, il doit donner en même temps mainlevée de mise en détention préventive... »

Par mainlevée de la détention, il faut entendre la cessation de la détention étant précisé que la détention préventive a entre autres buts de garantir le bon déroulement de l'instruction aussi bien au stade préparatoire que devant le juge. Il apparaît donc tout à fait normal que l'officier du ministère public qui s'est assuré de la personne d'un inculpé et estime ne pas pouvoir exercer les poursuites puisse rendre à celui-ci sa liberté.

Les mentions suivantes peuvent donner à cet acte de l'officier du ministère public un contenu plus ou moins valable :
