I am assuming that whether it's a question of a middle-sized object for sale or just a display of advertising, we have here a question over a common word which is also an important part of a trademark. The common term cannot be copyrighted or trademarked, but perhaps the display complained of uses the common word with typography that suggests the trademarked product - whereas the complainants would prefer to see the other product advertised with its differences emphasized more than its similarities. However, from the text it appears that the court did not take the other party to be at fault by prominently displaying the name or logo style that was the point of contention. -------------------------------------------------- Note added at 13 mins (2006-07-05 21:39:06 GMT) -------------------------------------------------- I'm sorry, I meant to take "middle-sized" out of that. If it's an object for sale, it could be of any size, obviously, but perhaps with the name or logo prominently displayed on the front or side of the product or container.
