My translation attempt:
The Publishing Company benefits as a consequence of the presumption of ownership of the infringing party.

Mais en fait c’est le contraire, la maison d'éditon a souffert et non bénéficié.

bénéficie, peut-être dans le sens de la présente assignation. Mais alors ça ne devrait pas être :
devrait bénéficier ou a droit aux bénéfices ou quelque chose comme ça ?
