Il s’agit de tout ce qui est trop général pour être susceptible d’appropriation, comme les recettes de cuisine (voir par exemple cette décision sur le sujet, les légendes, les histoires drôles...

En revanche, le fait de les mettre par écrit ou sous une autre forme un élément appartenant au fonds commun fait que cet élément est alors protégé, mais la protection ne concerne alors que la forme qu’il revêt, pas l’élément lui même.

Par exemple, vous écrivez un conte nouveau sur l’histoire du petit Poucet, votre conte est protégé mais l’historie du petit Poucet reste dans le fonds commun.
