Le délit d'entrave est constitué dès lors que employeur porte atteinte à la libre désignation ou à l'exercice régulier des fonctions d'un représentant élu du personnel ou d'un délégué syndical.

Le délit d'entrave s'applique également au Comité social et économique (CSE) destiné par la réforme du Droit du travail (ordonnances Macron) à regrouper l'ensemble des instances représentatives du personnel (DP, Comité d'entreprise, CHSCT, DUP).

disagree  R_S: il reato di impedimento è un reato ambientale, reato, penalmente sanzionato. Qui si parla di ostacolare l'esercizio delle funzioni di rappresentanza, sindacale o meno, dei lavoratori. A meno che si tratti di un romanzo, la traduzione non è corretta.
