While we're on the subject, a bit more competition theory ....

Die Bedingungen für eine glaubwürdige Markteintrittsandrohung auf der Ferngasebene wurden zuvor von Prof. X in einem Gutachten herausgearbeitet. Erstens, so der Professor und langjährige Direktor des Energiewirtschaftlichen Instituts an der Universität Köln, darf der Nachfragemarkt nicht zersplittert sein und die Kunden sollen Gestaltungskompetenz auch für komplexe Verträge, zum Beispiel bei der zeitlichen Bindung, haben. Zweitens müssen starke potenzielle Wettbewerber mit fachlichem Know-how existieren, um effektiv den Wettbewerb bestreiten zu können.

Explanation:
'Kompetenz' rarely means 'competence' in the traditional sense in English. This is not about whether customers are sufficiently expert in designing/drafting contracts (why on earth would the contracts be drafted by the customers?).

It's about customers having the opportunity to choose certain terms of the contract so that the market remains homogeneous and doesn't fragment into eg a six-month market, a one-year market, a five-year market etc.

I think we would phrase this slightly differently in English, almost certainly including the word 'flexible': 'even complex contracts should remain flexible, allowing for customers' own preferences eg in relation to the term of the contract' or 'should allow customers the flexibility to choose...' or something similar.
